Open Piano Competition terms and conditions


1.    Defined terms used herein:

Application (means, together, the Application Questionnaire, the audio recording and the Fee, as set out on the “Application Instructions” page of the Website required to enter into the Open Piano Competition)

Applicant (means any person who submits an application in accordance with the Competition Terms)

Application Instructions (means the instructions set out in the “Application Instructions” page of the Website)

Competition (means the Open Piano Competition)

Company (means Appassionati Ltd)

Directors (means the directors of Appassionati Ltd)

Initial Selection (means the Applicants the Directors select to go through to Round One)

Submission Deadline (means the deadline for submission of Application)

Quota (means the minimum number of applicants the Directors deem acceptable to enable the Competition to proceed to the Final Round and to award the monetary prizes set out in the “Prizes” “Application Instructions” page of the Website)

Reduced Quota (means the minimum number of Applicants received by the Submission Deadline that the Directors deem acceptable to enable the Competition to proceed to the Final Round and to award reduced monetary prizes)

Cancellation Decision (means a decision of the Directors to cancel the Competition due to receiving less than the Reduced Quota, or any other reason)

Intellectual Property Rights (means copyright and related rights and any other intellectual property rights, in each case whether registered or unregistered and all similar or equivalent rights or forms of protection in any part of the world)

Prizes (means any of the Prizes as set out in the “Prizes” page of the Website)

Prize Winners (means the Applicants who win the prizes in the Final Round)

Prize Winners Performances (means any recording or public performance or any other performance given by the Prize Winners of the Competition as a result of their participation in the Competition and any journalistic article, press interview, photo-shoot, radio and television or other appearance, arising out of the same during the Competition).

Territory (means the entire world)

Website (means the website of the Open Piano Competition: www.openpianocompetition.com)

2.    Interpretation

Should any dispute arise regarding the interpretation of any part of the Competition Terms, or Application Instructions, or any other part of the Competition, the decision of the Directors will be final and not subject to any appeal. No correspondence will be entered into. The Directors reserve the right to amend any of the Competition Terms contained herein, if they consider it necessary to give proper efficacy to the running of the Competition. The Application Questionnaire, Application Instructions and any other document or requirement forming part of the Competition is incorporated into these Competition Terms and by submitting any of the foregoing documents, the Applicant agrees to be bound the Competition Terms.

3.    Eligibility
The Competition is open to entrants aged 18 years or over only. Employees, consultants, advisers or agents of the Directors, their families and anyone professionally connected with the Competition are not eligible to apply.

4.    The Application
Applicants must fill in and submit the Application online at www.openpianocompetition.com in accordance with the Application Instructions” page of the Website. Incomplete or corrupted Applications and all those not in accordance with the Application Instructions will not be accepted. 

Applications will be deemed to have been submitted by the account holder of the e-mail address from which the entry is sent. The Directors accept no responsibility for Applications which are lost, damaged or delayed or as a result of any network, computer hardware or software failure of any kind and proof of sending will not be accepted as proof of receipt.

By submitting an Application, Applicants will be deemed to have consented to the transfer of their personal data to the Directors for the purposes of the Competition, and the Directors hereby declare to process such personal data in accordance with the Data Protection Act 1998, as amended. Applicants’ date of birth, nationality, first name and surname will appear on the Website in the event they succeed Initial Selection. Applicants are not required to consent to their data being processed for the purpose of sending them information regarding the Competition and the “Application Instructions” page of the Website and any other instructions, form part of the Competition Terms.

5.    The Application Fee
The Application Fee is non-refundable save for the instances set out in the Competition Terms in which a refund may be made.

6.    Initial Selection, Categorisation and Re-Categorisation

The decisions of the Directors are final and binding in all matters relating to the Initial Selection. No correspondence will be entered into.

In the event an Applicant's audio submission is of poor quality or if the Deadline has been extended, the Directors reserve the right to allow an Applicant to re-submit or submit a new audio recording, before the extended Deadline. If the Artistic Directors feel that the new audio recording differs greatly from the initial recording so much so that they feel the new recording may not be the Applicant's original work, the Directors reserve the right to request a video recording of the same. 

If the Applicant feels that the allocated category does not accurately reflect the Applicant’s pianistic ability the Directors may re-categorise the Applicant to an upper category, upon written appeal by the Applicant.

7.    Attendance

Applicants must give the Directors reasonable notice if they are unable to attend any part of the Competition. An Applicant who is unable to attend any part of the Competition is not eligible to receive a monetary Prize. An Applicant who is unable to attend any part of the Competition and who fails to respect the requirement to give reasonable notice to the Directors of their inability to attend, agrees to withdraw from the Competition.

8.    Accommodation and Travel
Costs of accommodation travel and any other cost incurred by the Applicant during the Competition will be met by the Applicant. It is the Applicant’s responsibility to ensure that they possess the requisite documentation to travel to the country in which the Competition is taking place. The Directors will assist all Applicants with VISA applications where required, by writing a letter of invitiation to the Competition.

9.    Cancellation Decisions
The Directors reserve the right to make a Cancellation Decision at any point after the Submission Deadline. In the event of a Cancellation Decision being made, the Directors will make all reasonable efforts to notify Applicants as soon as possible after the Cancellation Decision. In the event a Cancellation Decision is made after the Initial Selection but before Round One, Applicants will be refunded the Application Fee in full. In the event a Cancellation Decision is made at any other point in the Competition, Applicants will receive a refund of fifty percent (50%) of the Application Fee. The Directors reserve the right to deduct a reasonable administration fee from any refund made pursuant to this clause.

10.    Venues
Announcement of the venues for Rounds One, Two and the Final Round shall be announced after the Submission Deadline but before the start of each round. The Directors may change the venues at any time and notification to the Applicants of such change shall be made by announcement on the Website.

11.    Reduced Monetary Prizes
The Directors reserve the right to announce that the monetary prizes as set out in the “Prizes” ”Application Instructions” pages of the Website, may be reduced at any point after the Submission Deadline in the event of a Reduced Quota. The Directors will notify the applicants of such reduced prize amounts by announcement on the Website, as soon as is reasonably practicable for the Directors to do so.

12.    Intellection Property
Unless otherwise stated, all Intellectual Property Rights in or arising out of the Competition shall be owned by the Directors and their licensors. The Prize Winners agree to assign all Intellectual Property Rights in or arising out of the Prize Winners’ Performances to the Directors.

13.    Performance Rights

Whilst participating in the Competition, competitors will be contracted exclusively to the Competition which will have the right, without payment of fees, to: televise, film, video, tape-record, broadcast or photograph all stages of the Competition for media or any other purpose; produce documentary or feature films; produce and distribute recordings of all stages of the Competition, either in whole or in part.

14.    Limitation on Liability

By the Competition Terms the Applicants hereby agree to defend, indemnify and hold harmless the Directors, their subsidiaries and affiliated companies as well as their representatives, employees and professional advisors from and against any claims, damages, losses, costs and expenses, including but not limited to any reasonable legal fees ensuing from or connected to the Competition.

The Directors shall under no circumstances be held liable for any actual, direct, indirect, special, punitive, incidental, exemplary or consequential damage, or any other damage, whatever its nature, (even if the Directors were previously informed of the possibility of such damage) whether under contract, tort (including negligence), breach of statutory duty or otherwise, in respect of any single event or circumstance or set of connected events or circumstances arising out of or in connection with the Competition . In no event shall the Directors’ liability exceed the Application Fee less a reasonable administration fee. The Directors shall be under no liability for any delay or failure to perform any obligation if the same is wholly or partly caused by circumstances beyond their reasonable control. Nothing in these Competition Terms shall exclude or limit the Directors’ liability for death or personal injury caused by negligence or fraud.

15.    Miscellaneous
Disrespectful behaviour on the part of the Applicants during the Competition shall result in the withdrawal of the Applicant from the Competition and the loss of all rights obtained up to that time. Any falsehood discovered in an Application shall invalidate the Applicant.

16.    Governing Law
These terms and conditions shall be governed by the laws of England and Wales and any disputes shall be subject to the exclusive jurisdiction of the courts of England.
